Jane Doe v. Health Care Center (Superior Court – confidentiality settlement). Patient suffered from horrific headaches, nausea, vomiting, blurred and double vision, but was told she had the flu. Over several weeks no imaging studies were ordered of the patient’s brain to rule out an intracranial bleed or subarachnoid hemorrhage. Because of the failure of multiple healthcare providers to consider a subarachnoid hemorrhage and to rule one out by ordering a CT or MRI scan of the brain, the patient’s aneurysm ruptured, causing permanent brain damage.

Settlement $2,500,000+

If a worker is injured in the work place, he may file a worker’s compensation claim. An injured worker not only has a right to file a worker’s compensation, e.g. a Labor and Industries claim, but may also have a viable “third party claim” to recover damages against the contractor, subcontractor or any other independent trade which was negligent. This would be a claim against any negligent company or an employee of another company on a job site which caused the worker’s injury. The injured worker may file a third party claim against the employer of the negligent worker and arguably claim that the employer or its employee failed to enforce or follow certain WISHA or OSHA regulations.

EVERETT, Wash. — With temperatures warming up, a lot of people will open up those windows to let in cool air. But with kids around, an open window can turn deadly.

Trauma workers in Snohomish County said kids falling out of windows is more common than you think. For example, in Snohomish County Providence Hospital’s emergency room sees an average of 10 cases a year. So far they’ve already had 15 cases of kids falling out of windows.

“You hear stories all the time, and you think that, oh that could never happen at our house. So you do have to think all of the things when you’re child-proofing the house windows, outlets, covered doors, chemicals all those things,” said Tammy S., a mother of two young children.

According to Safe Kids USA, window falls account for 12 childhood deaths and 4,000 injuries for kids under the age of 10 annually. Experts remind parents window screens can only hold up to 5 pounds and they are meant to keep bugs out, not kids inside.

“Move furniture away from windows so they can’t climb up on furniture which will give them more force on that window screen, supervision that’s key to all of it create supervision,” said Shawneri Guzman with Safe Kids Snohomish Co.

Parents can find them safety latches and window guards online or at a hardware stores. They’re quick and easy to install and cost as little as $5. These window guards are a bit more ranging from $50 – $200.

KIRO 7 news partner The Daily Herald in Everett confirmed Thursday that John Doe, the Everett police officer at the center of a deadly shooting of an unarmed man, has been fired.

Everett police Chief Jim Scharf sent Doe a letter Thursday that stated, among other things, “the escalation from Taser to deadly weapon in less than 21 seconds is unfathomable.”

Doe shot Niles M. in June 2009 outside of the Chuckwagon Inn. Witnesses called police to tell them that Niles was too drunk to drive and when police arrived, he refused to get out of his car.

According to court documents, Doe tried tasering Niles. Another officer at the scene said Niles tried to drive away and his car ended up lodged against a fence and a parking curb. Soon after, the officer said, Doe said, “Time to end this; enough is enough,” and then opened fire.

Niles was shot seven times in the back.

Doe was later charged with second-degree murder and first-degree manslaughter but was acquitted.

Doe could still appeal his termination.

An animal farm located in Everett, Washington has been implicated in a recent outbreak of E. coli among 2 children and 2 adults who recently visited the farm. The Seattle Times reports that the exact strain of E. coli has not yet been determined. The farm is run by the Everett park department and over 25,000 people visit it each year, where people can come into contact with a variety of animals, including sheep, calves, piglets, chickens, goats, ducks, a horse, a pony and rabbits.

Bringing the general public into direct contact with animals can result in the transmission of a host of pathogens that are public health hazards. These hazards include bacteria, viruses, fungi, and parasites. Certain segments of the population are more at-risk for contracting these pathogens: the young, the elderly, pregnant women, and anyone with a suppressed or compromised immune system such as people infected with HIV/AIDS, cancer patients, and organ transplant recipients.

Public health officials have long recognized the need to maintain a sanitary environment in petting zoos and fairs, but outbreaks of E. coli O157:H7, Cryptosporidium, Campylobacter, and other diseases among fair and petting zoo attendees have drawn increased public attention to the need for animal exhibitors to involve local health departments, veterinarians, and sanitarians in planning to ensure a safe environment for exhibit attendees.

In July 2009, the Centers for Disease Control and Prevention (CDC) endorsed and published the National Association of State Public Health Veterinarians’ report, “Compendium of Measures to Prevent Disease Associated with Animals in Public Settings, 2009” (MMWR, May 1, 2009).

Major recommendations made by NASPHV in the report include:

Wash hands after contact with animals to reduce the risk of zoonotic disease transmission.

Do not allow food, drink, or pacifiers in animal areas.

Include transition areas between animal areas and non-animal areas.

Educate visitors about disease risk and prevention procedures.

Properly care for and manage animals.

Q. What do I need to prove to establish a successful medical malpractice case?

A. To win a medical malpractice case, three things must be proven. 1) The defendant failed to act according to established medical practice standards when treating the injured party; 2) This failure to follow standard practice resulted in your injury or suffering; and 3) damages to the injured party. As you can see, medical malpractice cases are complicated and require expertise.

If you believe that you or someone close to you has been victimized by medical malpractice, it’s about time you contacted a Seattle medical malpractice lawyer at our firm for a free legal consultation. However, it’s ideal that you do so ASAP to assure the time limit to file your claim, otherwise known as the statutes of limitations, doesn’t expire. Call 425-893-8989 now to make an appointment with an experienced personal injury lawyer at our firm.
